    This project requires you to find primary sources of law directly relevant to the situation and legal issue set out in the Project Scenario. “Directly relevant” means that the primary sources involve the same or similar legal issue and similar types of facts.
    YOU MUST USE THE FOLLOWING FORMAT FOR YOUR RESPONSES:

    THIS IS THE HYPOTHETICAL SCENARIOS

    Josie Duncan is employed as a mechanic at a plastics manufacturing plant in lowell, Massachesetts. She has been employed for several years and has received favorable performance reviews; she has never been the subject of any disciplinary proceeding. Recently the plant’s management announced a shift schedulling change for the mechanics that many of them, including Josie, felt would decrease the overtime pay to which they are legally entitled and which they had regularly earned in the past.
    Shortly after the changes were announced, osie encouraged her supervisor, LaVonne Smith, by the vending machine area, and mentioned to Ms Smith her concerns about the impact of the new schedule on overtime pay. Ms Smith told Josie that the new schedule would not negatively affect the overtime pay.Ms. Smith told Josie tht the new schedule would not negativelly affect the overtime to which the mechanics were entitled and could earn. Josie, who was not reassured by these statements, discussed the matter with some of her co-workers and came to share their belief that the plant management’s actions in changing the schedules shifts for mechanics may be in violation oof federal law. Josie started drafting an e-mail message to her supervison and to the plant manager, setting forth these concerns, and expression the intent to contact the U.S.Department of Labor about the matter.
    Josie never had a chance to send the e-mail. The week after she spoke with Ms.Smith, Josie was summoned to the manager’s office and told that due to the company’s recent slump in orders due to the recession, she and several other employees were being let go. Josie, however, believes her termination was a result of her complaints about the pending schedule changes and overtime pay.
    You have been asked to research only the issue of whether Josie’s actions in expressing her concerns were sufficient to protect her under the federal Fair Labor Standards Act’s prohibition on discharging or discriminating against employees who assert their rights under the Act. Do Not research the issue of whether management’s proposed schedule and overtime changes would violate the Act.
    You can cite, as persuasive authority, unpublished opinions from the Circuit Court of Appeals and District Court for the assigned jurisdiction.
