Jose, an 8 year-old boy, was injured while playing basketball with his friends. It was a pleasant summer evening, about 10:00 PM when he fell, dislocating his shoulder. He was admitted to the hospital, in extreme pain, and seen by the emergency center physician. After what seemed like forever, an ex-ray was done and the physician told Jose’s parents that surgery would be done” first thing in the morning” as there was no anesthetist on call , but that the anesthetist would arrive about 8:00 AM.
Jose was sedated and spent a long and painful night at the hospital. Following surgery, he developed a permanent disability of his should and arm due to the delayed surgery. His parents suit against the hospital. The emergency center physician and the anesthetist.
